By using this site, you signify your assent to these Terms and Conditions of Use and any modifications. If you do not agree to these Terms and Conditions of Use, you may not use the site.

Primary Membership Services and Fees

HotPluto.com offers a basic FREE service which includes; uploading 10 meg's of video, limited business description and placement into one of the available categories listed on the site. The Premium Services for HotPluto.com range from $19.95 to $99.95 per month. ALL PRICES QUOTED ARE IN U.S. DOLLARS (USD) PREMIUM PRICES MAY VARY BY COUNTRY.

The premium services include options that give the business owner extended video upload, listings in multiple categories, higher visibility placement on the home page and in color coded categories; the highest placement is in the Featured Ads area of the home page. Your Video Ad will display on every page throughout the Hot Pluto website. If when on a particular page and your Featured Video Ad does not appear, refresh the page until you see it. All Featured Ad's randomly load on each page. There are only 12 spots which actually appear in the featured Ads area. These 12 spots change each time a page is loaded--to insure all Featured Video Ads get equal views.

By registering with HotPluto.com, you authorize HotPluto.com to charge your credit card in the amount of the Premium Service Fee. HotPluto.com retains the right, in its sole discretion, to increase, at any time, the Service Fee. You must pay the Service Fee on a monthly basis. The Service Fee will be charged to your credit card on the anniversary day of the month your account was activated. You may update your credit card information at any time through the Billing Information profile.


PROMOTIONS: HotPluto.com may offer a 3-month FREE usage of the Level-1 Premium Service. During the registration process, credit card information will be included and at the end of the 3-month FREE trial, billing will begin at $19.95 a month unless the account is cancelled or another Premium Service is selected.

Should your credit card be inactive or otherwise unable to process the Service Fee due at the monthly anniversary date, HotPluto.com will notify you by e-mail. You will then have 7 days to update your credit card information in the Billing Information profile. If at the end of 7 days your credit card is still inactive or unable to process the Service Fee due, HotPluto.com reserves the right to plae your video ad in the basic or FREE mode or remove your Premium Service Video Ad(s) and all other information from our database and server and terminate your access to and use of the web site and all other services, without any further notice to you.

If after the 3-month FREE usage, you elect to use the Basic FREE service, you will have the opportunity to login in and resubmit information and video as it pertains to this service. HotPluto.com will always provide businesses or advertisers with a FREE service that includes; 10 megs of video, basic editing tools, one category listing and a basic business description.

Refund Policy

If at any time you are not satisfied with the service that HotPluto.com provides, you will have the right to submit in writing or via email to info@hotpluto.com, your dissatisfaction. Upon receipt of your refund request, HotPluto.com will credit the current months Service Fee to your credit card and will remove your Premium Service account from our database and server; or allow you to resubmit information and video as requested in the Basic FREE service.


Termination

You agree that HotPluto.com may restrict or terminate your use of the web site, with or without notification to you, should you intentionally attempt to damage the site or violate any member’s security or right of privacy. You also agree that the submission of pornographic material, use of profanity, use of words or phrases that discriminate based on race, sex, color or religious beliefs is prohibited on this site and will constitute immediate removal of the offending account. If any of the above requires the removal of an account, the account owner will be notified and there will be no refund or prorating of the most recent payment. Further payments will not be deducted from the affected account as a result of account termination.

Privacy

We periodically employ third parties to perform various functions on our behalf. Such functions may include, for example, web site hosting, data analysis, marketing research, processing credit card payments and providing customer service. The third parties performing such functions will have limited access to your personal information solely as may be necessary for them to perform such functions.

We may also share your personal information if we believe it is necessary to comply with the law, to enforce or apply our Terms and Conditions, or to protect the rights, property or safety of HotPluto.com or our users.

The HotPluto.com site uses cookies to assist in providing our services to you. Arbitration of Controversies

All disputes arising from or related to these Terms & Conditions or the HotPluto.com service shall be submitted to binding arbitration. The arbitration shall take place in Los Angeles County, California, before an attorney or retired judge who is acceptable to the parties. If the parties are unable to agree on an arbitrator, then an arbitrator shall be appointed in accordance with California Code of Civil Procedure. The parties will share equally in the fee of the arbitrator. Each party shall bear its own other costs and attorneys’ fees associated with the arbitration.

Each party shall be entitled to inspect documents in the other party’s possession or control prior to the hearing. The parties may obtain additional pre-hearing discovery only by agreement or by applying to the arbitrator, who shall rule on all discovery and procedural issues.
